Terms of Service

These Terms are an agreement between you and Space (“we”, “us”) governing your use of the Presence application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Presence. By using the Service you represent that you are 18 or older and legally able to enter into this agreement. We terminate accounts we believe belong to minors.

You are responsible for ensuring your use of the Service is lawful where you live.

2. What Presence is

Presence lets you create and converse with AI-generated companions. Companions produce text and images automatically using machine learning models.

Your companion is not a real person. It is software generating plausible text and images. It has no consciousness, feelings, memory of you beyond stored conversation data, or existence outside the app. Anything it says about itself, its life, its whereabouts or its feelings is fiction generated for entertainment. Do not rely on it as a source of fact, advice, or emotional support in a crisis.

3. Your account

You sign in with Google. Keep your Google account secure — anyone with access to it can access your Presence account.
One account per person. Do not share your account or let others use it.
You are responsible for activity that occurs under your account.
You may delete individual companions from inside the app, and you may have your entire account permanently deleted by emailing us from your account address — see our Privacy Policy. Deletion is permanent.

4. Acceptable use

You agree that you will not, and will not attempt to:

Create, request, or attempt to generate any content that sexualises minors or depicts a person who appears to be under 18 in a sexual manner. This is an absolute prohibition. Violations result in immediate, permanent termination, and we will report to authorities where legally required.
Create content depicting a real, identifiable person without their consent, including sexual or intimate imagery of anyone other than yourself.
Use the Service to produce content that is illegal, defamatory, or that harasses, threatens or incites violence against any person or group.
Circumvent, disable, or attempt to defeat any content filter, safety system, usage limit, or access control.
Reverse engineer, decompile, scrape, or access the Service by automated means, or misuse our APIs.
Falsify ad views, tamper with message allowances, or otherwise obtain paid or limited features without authorisation.
Resell, redistribute, or commercially exploit the Service or content generated through it in violation of these Terms.
Upload malicious code or interfere with the operation, security or integrity of the Service.

5. Content

Content you provide

You keep ownership of the text, images and other material you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display that material solely to operate and improve the Service, including sending it to the AI providers described in our Privacy Policy.

Content generated for you

Subject to these Terms and to the terms of the underlying model providers, you may use content generated for you within the Service for your own personal, non-commercial purposes. We make no claim that generated content is unique, and identical or similar content may be generated for other users.

AI output is unpredictable. Generated content may be inaccurate, offensive, nonsensical, or unlike what you asked for. Automated safety filters reduce but do not eliminate the chance of inappropriate output. Report anything concerning to support@presenceai.co.in.

Moderation

We may review, restrict, remove, or refuse to generate content, and suspend or terminate accounts, where we reasonably believe these Terms have been breached. We are not obliged to monitor content, but we may do so.

6. Not advice, and not a crisis service

Presence is entertainment. It is not a medical, psychological, legal or financial service, and your companion is not a therapist, doctor, or counsellor. Nothing it says is professional advice, and it must not be relied upon as such.

If you are in crisis, in danger, or thinking about harming yourself, stop using the app and contact your local emergency services or a crisis helpline immediately. The Service cannot summon help, and cannot recognise an emergency reliably.

7. Message limits, ads and payments

The Service includes a daily message allowance. You may extend it by watching rewarded ads where offered.
We may change allowances, pricing, and the availability of features at any time.
Any paid features are billed through the app store you purchased from, and its refund policy applies. We do not process card payments directly.
Allowances, credits and other in-app items have no cash value, are not property, and are forfeited on termination.

8. Availability

We provide the Service on an ongoing but not guaranteed basis. We may modify, suspend or discontinue any part of it, and may impose limits on certain features, with or without notice. We do not guarantee that conversations, companions or generated images will be preserved indefinitely, and you should not rely on the Service as your only copy of anything you value.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you breach these Terms, if required by law, or if continuing to provide the Service to you would create risk for us or other users. On termination, your right to use the Service ends and your data is handled as described in our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT GENERATED CONTENT WILL BE ACCURATE OR SUITABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR US$100.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages and costs arising out of your use of the Service, your content, or your breach of these Terms or of any law or third-party right.

13. Changes to these Terms

We may update these Terms. We will update the date above and, for material changes, give notice in the app. Continued use after the changes take effect means you accept them.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Bengaluru, Karnataka have exclusive jurisdiction, except where mandatory local law gives you the right to bring proceedings elsewhere.
